These Terms apply when you use the Ars Club website or purchase products from Ars Club (“Ars Club”, “we”, “us” or “our”).

By using the website or placing an order, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot legally be excluded, including rights under the Australian Consumer Law.

Products & Information

We make reasonable efforts to accurately describe our pet products, including materials, dimensions, colours, compatibility, capacity, care instructions and size guidance.

Colours and appearance may vary slightly depending on your device, display or product batch. Pet sizes, breeds and individual needs vary, so customers should review measurements and product-specific instructions before ordering.

Products must be used under appropriate supervision and in accordance with their intended purpose. No product replaces professional veterinary advice, diagnosis or treatment.

Prices & Orders

Prices are displayed in Australian dollars (AUD) unless otherwise stated.

You are responsible for providing complete and accurate order, contact, delivery, sizing and personalisation information.

We may refuse or cancel an order where reasonably necessary because of suspected fraud or unauthorised activity, a genuine pricing or listing error, stock or fulfilment unavailability, or another legitimate reason permitted by law. Where we cancel a paid order, the applicable amount paid will be refunded.

Promotions and discount offers are subject to their stated terms and may not be combined unless expressly stated.

Personalised Products

Please carefully check all names, phone numbers, sizing and other personalisation details before placing your order.

Personalised and custom-made items cannot normally be cancelled, returned or exchanged for change of mind once production has commenced. Errors resulting from information supplied incorrectly by the customer are the customer’s responsibility.

This does not affect your rights where we made the error or where the item is faulty, damaged, unsafe or not as described.

Product Suitability & Pet Safety

Always select products that are appropriate for your pet’s size, weight, behaviour and health. Inspect collars, harnesses, leads, fountains, grooming tools and accessories regularly for wear or damage, and stop use if a product becomes unsafe.

Water fountains, pumps, filters and electrical accessories must be installed, cleaned and maintained in accordance with the product instructions. Keep electrical components away from inappropriate moisture exposure and supervise pets where reasonably required.

If you have concerns about a pet’s health, hydration, skin, coat, mobility or behaviour, seek advice from a qualified veterinarian.

Shipping & Returns

Shipping and delivery are subject to our Shipping & Delivery Policy.

Returns, exchanges, cancellations and refunds are subject to our Returns & Refunds Policy.

Customers are responsible for providing accurate delivery information and making reasonable arrangements to receive or collect their order.

Third-Party Services

Our website may use or link to independent third-party services, including Shopify, payment providers, fulfilment providers and technology providers. Their services may be subject to their own terms and privacy practices.

This does not remove Ars Club’s responsibility for products sold through our store or obligations that cannot legally be excluded.

Site Use & Intellectual Property

You must not use the website unlawfully, fraudulently, to interfere with its operation or security, to transmit malicious software, or to infringe another person’s rights.

Website content, branding, graphics, photographs and other materials may be protected by intellectual property laws and must not be commercially reproduced without permission except where permitted by law.

If you submit a review, photograph or other content to us, you confirm that you have the right to provide it and give us permission to display and use it in connection with our business and marketing, subject to applicable law.

Site Availability

We do not guarantee that the website will always be uninterrupted or error-free and may suspend or modify functionality where reasonably necessary.

Liability

To the maximum extent permitted by law, Ars Club is not liable for indirect or consequential loss where such liability can lawfully be excluded.

We are not responsible for loss caused solely by incorrect information or actions supplied by the customer, misuse contrary to product instructions, or events outside our reasonable control, except where responsibility cannot legally be excluded.

Nothing in these Terms excludes or limits any consumer guarantee, right, remedy or liability that cannot legally be excluded under the Australian Consumer Law.

Changes & Governing Law

We may update these Terms from time to time. Changes apply prospectively and will not remove rights already arising from an existing order.

If any provision is unenforceable, the remaining provisions continue to apply. These Terms are governed by applicable Australian law.
